End User License Agreement (EULA)

This End User License Agreement (“Agreement” or “EULA”) is a legally binding contract between you (“User,” “you,” or “your”) and Horse HookUp Pty Ltd (“Horse HookUp,” “we,” “our,” or “us”), governing your use of the Horse HookUp application, website, and all related services (“Service”).

By accessing, downloading, installing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by this EULA, as well as our Terms & Conditions and Privacy Policy. If you do not agree, you must immediately discontinue use of the Service.

1. License Grant

Horse HookUp grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for personal, non-commercial purposes, subject to this Agreement.

2. User-Generated Content (UGC)

2.1 Ownership of Content

You retain full ownership of any content you upload or submit through the Service, including posts, comments, photos, listings, events, ride logs, messages, or any other material (“User Content”).

2.2 License to Horse HookUp

By submitting User Content, you grant Horse HookUp a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to:

  • Use
  • Reproduce
  • Display
  • Modify
  • Adapt
  • Publish
  • Translate
  • Distribute
  • Create derivative works

This license is solely for the operation, promotion, improvement, and functionality of the Service.

2.3 Representation and Warranty

You represent and warrant that:

  • You own or have the legal right to use and upload the User Content.
  • Your content does not infringe on any third-party rights, including copyrights, trademarks, privacy, or publicity.
  • Your content complies with all applicable laws and this Agreement.

2.4 User Responsibility

You are solely responsible for your User Content and any consequences that arise from posting or sharing it.

3. Prohibited Content & Zero-Tolerance Policy

Horse HookUp maintains a strict zero-tolerance policy toward objectionable or abusive content. You agree not to upload, share, or engage in any content or behavior that includes:

  • Hate speech, harassment, bullying, or threats
  • Discrimination or violence
  • Pornographic, sexually explicit, or suggestive material
  • Illegal activities, including fraud or impersonation
  • Defamation or misinformation
  • Content harmful to minors
  • Content violating intellectual property rights
  • Malware, spam, or harmful code

Violations may result in immediate suspension or termination of your account, removal of content, and notification to authorities when appropriate.

4. User Conduct

You agree to:

  • Use the Service in compliance with all applicable laws
  • Respect others’ privacy, rights, and safety
  • Avoid actions that disrupt or interfere with the Service, including scraping, reverse engineering, or unauthorized access
  • Refrain from using the Service for commercial purposes unless expressly permitted

5. Account Responsibilities

You are responsible for:

  • Keeping your login credentials secure
  • All activity under your account
  • Notifying us immediately of unauthorized access or security concerns

Horse HookUp is not liable for loss or damage arising from unauthorized account use.

6. Updates, Changes, & Access

Horse HookUp may modify, update, or discontinue parts of the Service, push automatic updates to your device, or restrict access for maintenance or operational reasons. You acknowledge that these actions may occur without prior notice.

7. Intellectual Property Rights

All intellectual property associated with the Service—including software, branding, graphics, features, and design—is owned by Horse HookUp or its licensors. Except where expressly allowed, you may not copy, modify, or distribute our materials, reverse engineer or decompile the Service, or use trademarks without written permission.

8. Termination

We may suspend or terminate your access at our sole discretion, with or without notice, for reasons including violations of this EULA or our Terms, posting objectionable or harmful content, misuse of features, or legal or operational requirements. Upon termination, your license to use the Service immediately ends.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose, accuracy or reliability, or uninterrupted or error-free operation. You use the Service at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, Horse HookUp is not liable for indirect, incidental, punitive, or consequential damages, loss of data, profits, or goodwill, damages arising from User Content, unauthorized access to your account, or third-party conduct or services. Our total liability shall not exceed the amounts paid by you to use the Service (if any) within the previous 12 months.

11. Indemnification

You agree to defend, indemnify, and hold Horse HookUp, its directors, officers, employees, and affiliates harmless from any claims or damages arising out of your misuse of the Service, your User Content, or your violation of this EULA or any applicable laws.

12. Governing Law

This Agreement is governed by the laws of Australia, without regard to conflict of law principles. Any disputes will be handled through arbitration, as detailed in our Terms & Conditions.

13. Changes to This EULA

We may update or amend this EULA at any time. Continued use of the Service after an update constitutes acceptance of the revised Agreement.
